Brother Khrystus V. K. Wallace's' Sedition Case against The Federation of St. Kitts and Nevis (The Crown) continued on Tuesday, 21st April, 2015 at The Basseterre Court with Magistrate Mallelieu presiding.
For the first time since Brother Khrystus' arrest and incarceration for 6 months with bail denied all that time, and after appearances at The Basseterre Court for over some 24 + times since May, 27th 2013, the Director of Public Prosecution was present along side Superintendent Charles Smithen, Head of The Criminal Investigation Division and Corporal Audain, Head of the Information Technology Forensic Unit at The Royal St. Christopher and Nevis Police Force.
Having again read the charges that The Royal St. Christopher and Nevis Police Force brought against Brother Khrystus some three months after the launch of his radical Blazing Star Movement - www.theblazingstarmovement.com Youth Party, Senior Learned Magistrate Mallelieu asked the Director of Public Prosecution what was the position regarding the case because it had been on her books since May, 27th 2013 and if they wanted to proceed.
The D.P.P then said that The Royal St. Christopher and Nevis Police Force had found the two missing laptops in the stores and they had found over 20,000+ emails that they were still processing to prepare for the case and asked for THREE (3) more months to put a proper case together.
Brother Khrystus addressed the court and told the learned Magistrate that never in his life did he ever use any of those laptops to access and retrieve emails, so that wasn't the truth.
A seemingly utterly disgusted Learned Magistrate Mallelieu immediately denied the request of The D.P.P and said that that could not happen and said that when the police arrested Mr. Wallace, they should have had FULL EVIDENCE OF THE WRONG HE WAS ALLEGED TO HAVE COMMITTED before arresting and charging him and incarcerating him for so long.
Magistrate Mallelieu further postulated in open court that it was totally unfair for The Police to be going through Mr. Wallace's personal and business items and files like that and questioned whether or not The Police were FISHING FOR EVIDENCE after so long in order to make up a case.
Brother Khrystus' Lawyer practicing for over fifty years across the Eastern Caribbean, with partner offices in the United Kingdom and Canada, Sir Nassibou Butler argued that when he went before Justice Ramdhani, the Learned Justice spent an excessive amount of time reading through many of Brother Khrystus' Blazing Star Movement - www.theblazingstarmovement.com political articles that he was writing and publishing ONLINE and in particular the said article on which he was arrested on and deemed SEDITIOUS. Lawyer Butler told the court that Justice Ramdhani stated that he saw NOTHING SEDITIOUS that should prevent his client from getting bail after all other magistrates and judges had denied bail over a 6 month period.
Lawyer Butler stressed that his client was released on a mere EC$5000 / US$1840 bail suggesting that Learned Judge Ramdhani didn't see that the alleged Seditious Publication crime warranted so much local, regional and international attention by arresting a 26 year old aspiring Prime Minister of The Federation of St. Kitts and Nevis for 6 months.
Learned Magistrate Mallelieu then denied the three (3) month request of the senior state prosecutor - The DPP, and asked him to file the disclosure with ALL evidence that the Crown had on Mr. Wallace by Friday, 24th April, 2015 along with a copy at the chambers of Sir Nassibou Butler and report to court on Tuesday, 28th April, 2015 so a determination can be made on the matter.
The D.P.P, having explained that the Nevis Assizes were ongoing, Magistrate Mallelieu reconsidered and gave three weeks back before all parties return to court.
The world would remember that under The Former Prime Minister Dr. Denzil Douglas St. Kitts - Nevis Labour Party Administration, on Monday, 27th May, 2013, Superintendent Charles Smithen, head of the Criminal Investigation Unit accompanied by fully armed soldiers and police carrying SUPER - SUPER LARGE MILITARY STYLE WEAPONS and surrounded with K9 dogs raided the Wallace Family Home and KVK ENTERPRISES - www.kvklives.com business place without a court order and search warrant.
Superintendent Charles Smithen's team turned The Wallace family home and business place UPSIDE DOWN searching for drugs, guns and ammunition and embarrassingly found nothing.
Superintendent Charles Smithen then instructed his officers to take ALL of the Wallace's and KVK ENTERPRISES desktop computers, laptops, external hard drives holding 11 years of business information, soft copies of books to be published and critical expensive software and files, pen drives, cell phones, dongle keys to run expensive printing equipment such as the business' large format printer that prints banners, signs, architectural drawings, posters, number plates, labels, t-shirts and more and many critical business files from the filing cabinet.
When the court ordered that the police return these items, only ONE of the most important items was in working order. EVERYTHING ELSE WAS DAMAGED BEYOND REPAIR and secured by Lawyer Nassibou Butler as EXHIBITS.
The question is, what will become of Brother Khrystus and his ongoing sedition case brought by THE CROWN that has been ongoing for close to two years?
Former Prime Minister Dr. Denzil Douglas over one month ago, had contacted The Dare 2 Be Different International Media Department asking the team to clear his name and retract statements made in several articles that he, as Former Prime Minister and Minister of National Security ever had anything to do with Brother Khrystus' arrests.
Former Prime Minister of The Federation of St. Kitts and Nevis, Dr. Denzil Douglas claimed that The Royal St. Christopher and Nevis Police Force operates as an INDEPENDENT BODY and makes operational decisions off its own, without the involvement of the minister. Dr. Douglas DENIED that he ever gave any ORDERS for any of Brother Khrystus' arrests and all such statements made in the media and uttered by individuals were COMPLETELY FALSE.
Former Prime Minister Dr. Denzil Douglas, having been updated after this Tuesday's matter on Brother Khrystus' Sedition Case, and informed that he may have to testify should the case proceed, communicated with Brother Khrystus directly stating, "LABOUR HAD NOTHING TO DO WITH YOUR MISFORTUNE. IN FACT THE LABOUR LEADER TRIED TO HELP PERSONALLY."
Lawyer Butler in speaking with The Dare 2 Be Different International Media House stated that he would have thought that since the matter of a Seditious Publication Charge which suggested that his client Brother Khrystus wanted to overthrow the former Denzil Douglas Government and form a Blazing Star Movement Administration, was brought under an old administration, that the New Team Unity Administration and its Cabinet and Attorney General would have discussed whether or not they wanted to proceed with such a charge, especially since it was a NEW GOVERNMENT. Lawyer Butler stated that he was quite surprised to hear that the D.P.P wanted three more months to prepare when the case has been before him for almost two years.
Brother Khrystus who has been racking up significant legal fees since May, 2013 that have to be paid, told our media house, "All I ask the world to do now is to pray. I've left the matter in the hands of GOD and he knows what is best."
The matter has been inherited by New Prime Minister Dr. Timothy Harris, Leader of the Team Unity Coalition and Leader of The People's Labour Party and The People's Action Movement Deputy Prime Minister Shawn Richards and Premier Vance Amory of The Concerned Citizens Movement are the key figures along with their colleagues who are currently responsible for running the affairs in The Federation of St. Kitts and Nevis.
